Elle r\u00e9v\u00e8le que les dispositions l\u00e9gales ont des effets discriminatoires envers les femmes non ressortissantes de l\u2019Union europ\u00e9enne ou de l\u2019AELE. Ces derni\u00e8res n\u2019ont pratiquement aucune possibilit\u00e9 d\u2019obtenir une autorisation de s\u00e9jour en vue d\u2019exercer une activit\u00e9 lucrative. Elles peinent aussi \u00e0 se voir reconna\u00eetre la qualit\u00e9 de r\u00e9fugi\u00e9e. De fait, un grand nombre de femmes vivent l\u00e9galement en Suisse dans le cadre du regroupement familial, avec toute la d\u00e9pendance que cela suppose du point de vue de l\u2019autorisation de s\u00e9jour, et des cons\u00e9quences dramatiques en cas de violence conjugale. Beaucoup d\u2019autres sont confin\u00e9es \u00e0 la clandestinit\u00e9 et \u00e0 la pr\u00e9carit\u00e9.<\/p>\n<p>English :<\/p>\n<p>In this article, the authors analyze the possibilities for migrant women to obtain stable residency status in Switzerland. It argues that the legal provisions have discriminatory effects on women who are not citizens of the EU or EFTA. It is virtually impossible for these women to obtain a permit to work legally in Switzerland. Furthermore, they also have difficulty gaining recognition as refugees. Finally, while a large number of women are able to live legally in Switzerland through family reunion provisions. The dependency this involves can have tragic consequences, especially in cases of domestic violence.
