Quels effets cette construction peut-elle avoir sur leurs trajectoires de vie ? Il existe une tension entre deux principes dans les soci\u00e9t\u00e9s contemporaines et elles peuvent \u00eatre contradictoires : d\u2019une part le souci universel de prot\u00e9ger l\u2019enfance qui se cristallise dans la Convention internationale des droits de l\u2019enfant (Cide), et d\u2019autre part la d\u00e9l\u00e9gation de la gouvernance des migrations internationales aux \u00c9tats, lesquels d\u00e9finissent, selon leurs propres crit\u00e8res, qui a la l\u00e9gitimit\u00e9 d\u2019entrer et de s\u00e9journer dans le cadre des fronti\u00e8res qu\u2019ils contr\u00f4lent. Les mineurs non accompagn\u00e9s symbolisent cette contradiction, car d\u2019une part il s\u2019agit d\u2019enfants en situation de vuln\u00e9rabilit\u00e9 qui doivent \u00eatre l\u2019objet de protection selon la Cide, d\u2019autre part d\u2019\u00e9trangers qui doivent avoir de \u201cbonnes\u201d raisons pour que leur pr\u00e9sence sur un autre \u00c9tat que le leur soit accept\u00e9e par les autorit\u00e9s de la soci\u00e9t\u00e9 qui les accueille.&#8221;<\/p>\n<p>&#8220;In what way is the situation of minors arriving in Switzerland without their parents \u201cconstructed\u201d by the legislation ? What are the possible effects of this construction on the course of their lives ? A tension exists between two different principles in contemporary society and they can find themselves in opposition. On the one hand there is the universal concern for the protection of children, given definition by the United Nations Convention on the Rights of the Child (UNCRC). On the other hand, the management of international migration is delegated to states which define who may enter and reside within the borders they control, according to their own criteria.
