“\u00c0 partir d\u2019une enqu\u00eate sociohistorique et ethnographique, cet article ana<\/span>lyse la judiciarisation de la politique suisse d\u2019asile, ses ressorts et ses effets. <\/span>En s\u2019int\u00e9ressant aux pratiques et aux strat\u00e9gies de l\u2019administration et de la <\/span>
d\u00e9fense juridique des migrant\u00b7e\u00b7s, il met en lumi\u00e8re la co-production con<\/span>flictuelle du droit d\u2019asile qui passe par des coups strat\u00e9giques et par des <\/span>anticipations r\u00e9ciproques <\/span>entre <\/span>l\u2019administration <\/span>et la d\u00e9fense juridique, <\/span>mais aussi par la production d\u2019une juri<\/span>sprudence qui participe \u00e0 la sophisti<\/span>cation du droit d\u2019asile et de sa mise en \u0153uvre. C\u2019est donc d\u2019abord au niveau <\/span>de l\u2019interpr\u00e9tation et de l\u2019application du droit par l\u2019administration que la <\/span>d\u00e9fense juridique permet d\u2019infl\u00e9chir, <\/span>\u00e0 la marge, la politique d\u2019asile.” <\/span><\/div>\n

“This article is based on a sociohistorical and ethnographic survey. It analyz<\/span>es the judicialization of the Swiss asylum policy and its practical effects. <\/span>Focusing on the practices and legal strategies of the street-level bureaucracy <\/span>and of the legal defense of migrants, this article argues that there is an ad<\/span>versarial co-production of asylum law. This process involves strategic moves <\/span>and mutual anticipation between the ad<\/span>ministration and the legal defense, <\/span>but also the production of case law that contributes to the sophistication of <\/span>asylum law and its implementation. It is therefore primarily at the level of <\/span>the interpretation and application of the law by street-level bureaucracy <\/span>that legal mobilizations make it possible to change, at the margin, asylum <\/span>policy.”<\/span><\/div>\n
