Abstract: <\/strong><\/p>\n

“L\u2019auteur s\u2019 interroge sur le r\u00f4le du droit suisse migratoire dans le cadre de l\u2019obligation en droit international de pr\u00e9venir l\u2019exploitation au travail. Il examine en particulier la situation juridique des migrants qui travaillent dans l\u2019\u00e9conomie domestique. L\u2019article conclut que le droit suisse migratoire se situe, actuellement, dans une logique de gu\u00e9rison plut\u00f4t que de pr\u00e9vention.”<\/p>\n

“Der Beitrag befasst sich mit der Rolle des schweizerischen Migrationsrechts in Bezug auf v\u00f6lkerrechtliche Verpflichtungen zur Pr\u00e4vention der Ausbeutung von Arbeitskr\u00e4ften. Er legt ein besonderes Augenmerk auf die rechtliche Situation von ausl\u00e4ndischen Haushaltshilfen. Der Artikel kommt zum Schluss, dass die aktuelle Gesetzgebung der Schweiz im Bereich Migrationsrecht st\u00e4rker auf Wiedergutmachung als auf Pr\u00e4vention setzt.”<\/p>\n

“This article examines the Swiss migration law in the light of the obligation under international law to prevent labour exploitation. It focuses on the legal situation of the migrant domestic workers. The article reaches the conclusion that Swiss migration law\u2019s current paradigm is reparation rather than prevention.”<\/p><\/blockquote>\n
