“Suivant des travaux sur la (re)production des fronti\u00e8res par le bas, dans les pratiques des agents et des agentes de terrain et de leurs usages du droit, cet article analyse les enjeux li\u00e9s aux autorisations de s\u00e9jour des femmes migrantes confront\u00e9es aux violences conjugales. \u00c0 travers le cas suisse, et par l\u2019analyse des documents l\u00e9gaux et administratifs qui r\u00e8glent la situation des migrantes, l\u2019auteure montre comment ces femmes sont mises devant un choix impossible entre se s\u00e9parer du conjoint ou rester en Suisse. L\u2019article d\u00e9montrera comment la mise en \u0153uvre du droit devient un instrument de contr\u00f4le de la migration et renforce les fronti\u00e8res de l\u2019Etat, en distinguant celles qui sont jug\u00e9es aptes \u00e0 recevoir une protection et celle qui, priv\u00e9es de ce droit, doivent partir.”<\/p>\n

Domestic Violence on the Fringes: The Case of Migrant Women in Switzerland<\/h3>\n<\/div>\n

“In line with research on the (re)production of borders from below in the practices of field officers and their application of the law, this article analyzes issues related to residency rights for migrant women confronted with domestic violence. Based on the Swiss case, and by analyzing the legal and administrative documents that regulate the situation of migrant women, the author shows how these women are confronted with the impossible choice of either leaving their husbands or remaining in Switzerland. The article shows how the law becomes an instrument of migration control and strengthens the borders of the State, by drawing a distinction between those who are considered eligible for protection and those who are not and therefore are forced to leave.”<\/p>\n
