“Impuls\u00e9e par des \u00e9lus de l\u2019UDC pour contourner des d\u00e9cisions politiques et judiciaires prises au niveau local, puis national, l\u2019initiative populaire accept\u00e9e en 2009 visant l\u2019interdiction de construire des minarets a r\u00e9activ\u00e9 la stigmatisation des musulmans \u00e9tablis en Suisse, ainsi qu\u2019un ensemble de controverses opposant syst\u00e9matiquement, dans une configuration institutionnelle particuli\u00e8re, la d\u00e9mocratie directe aux droits fondamentaux, la \u00ab volont\u00e9 populaire \u00bb au \u00ab pouvoir des juges \u00bb, nationaux et internationaux. Polys\u00e9mique, le concept de judiciarisation est appr\u00e9hend\u00e9 ici dans une perspective processuelle et relationnelle, non pas comme transfert vers l\u2019ar\u00e8ne judiciaire de questions politiques touchant la r\u00e9gulation publique du religieux, mais sous l\u2019angle de la juridicisation de la controverse suscit\u00e9e par l\u2019initiative populaire que produit l\u2019anticipation des d\u00e9cisions de justice dans les \u00e9changes politiques.”<\/p>\n

“Launched by representatives from the Union d\u00e9mocratique du centre (UDC) with the aim of circumventing political and judicial decisions made at both local and national levels, the 2009 federal popular initiative calling for a ban on the construction of minarets rekindled the stigmatisation of Muslims living in Switzerland. Within the prevalent institutional configuration it moreover revived controversies surrounding issues such as direct democracy versus fundamental rights, or \u201cthe will of the people\u201d versus \u201cthe power of the judges\u201d, whether national or international. \u201cJudicialisation\u201d is a polysemous concept. It is not understood here as the transfer to the courts of matters of political significance \u2013 in this instance the public regulation of religion \u2013 but as a process of juridification (or juridicalisation) in which court rulings were constantly anticipated in the political debate provoked by the popular initiative.”<\/p>\n<\/div>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"
