The issue of migration is a current topic in different European countries. In this paper, we concentrate on the case of Switzerland. After the adoption of the Mass Immigration Initiative on 9 February 2014, Switzerland is faced with a challenging task. It needs to implement the constitutional mandate to manage migration autonomously, although Switzerland has a bilateral free movement of persons agreement with the EU. We present an approach to a solution for discussion. The basic idea is to maintain the principle of freedom of movement without fixed quotas or national priority but with a safeguard clause for (statistically) exceptional situations. An exceptional situation occurs if serious social, economic or political difficulties arise. As an objective method to determine serious difficulties, we choose an excessive percentage in net migration, defined on the basis of the situation in the EU\/EFTA. If the net migration in Switzerland is getting excessive, the safeguard clause could be called. In addition, we take other factors into account such as the amount of the EU\/EFTA foreigners and the labor market.<\/p>\n

Die Problematik der Migration ist in verschiedenen L\u00e4ndern Europas ein aktuelles Thema. Am Beispiel der Schweiz, welche nach der Annahme der Einwanderungsinitiative vom 9. Februar 2014 vor dem herausfordernden Problem steht, wie sich der Verfassungsauftrag einer autonomen Steuerung der Migration mit den bilateralen Vertr\u00e4gen mit der EU und der daf\u00fcr essentiellen Personenfreiz\u00fcgigkeit vereinbaren l\u00e4sst, stellen wir einen L\u00f6sungsansatz zur Diskussion vor. Die Grundidee dieses Vorschlages ist grunds\u00e4tzliche Freiz\u00fcgigkeit unter Verzicht von fixen Kontingenten oder Inl\u00e4ndervorrang, jedoch mit einer Schutzklausel f\u00fcr (statistische) Ausnahmesituationen. Eine Ausnahmesituation ist dann vorhanden, falls ernsthafte soziale, \u00f6kologische, \u00f6konomische oder politische Schwierigkeiten auftreten. Als objektive Gr\u00f6sse zur Definition von ernsthaften Schwierigkeiten w\u00e4hlen wir eine \u00fcberm\u00e4ssige prozentuale Nettomigration. \u00dcberm\u00e4ssigkeit wird anhand der Situation in der EU\/EFTA definiert. Wird die Nettomigration in der Schweiz \u00fcberm\u00e4ssig, soll die Schutzklausel angerufen werden k\u00f6nnen. Neben dem Referenzwert der Nettoeinwanderung der EU\/EFTA-Staaten ber\u00fccksichtigen wir weitere Faktoren wie den Bestand der EU\/EFTA-B\u00fcrger und makro\u00f6konomische Parameter des Arbeitsmarktes.<\/p>\n<\/div>\n<\/div>\n<\/blockquote>\n
