Cet article analyse le dispositif d\u2019\u00e9loignement des \u00e9trangers ind\u00e9sirables en se fondant sur le cas des requ\u00e9rants d\u2019asile d\u00e9bout\u00e9s en Suisse. Il remet en question le discours selon lequel la \u00ab\u00a0politique de retour\u00a0\u00bb suisse reposerait avant tout sur des mesures d\u2019incitation au d\u00e9part pour ne faire usage de la contrainte qu\u2019en dernier recours. L\u2019analyse effectu\u00e9e permet en effet de souligner le r\u00f4le de diverses formes de contraintes (juridiques, mat\u00e9rielles et psychologiques), dont usent les autorit\u00e9s d\u00e8s l\u2019annonce de la d\u00e9cision de renvoi. Ces formes de contraintes pr\u00e9sident \u00e0 l\u2019\u00e9loignement de ces \u00e9trangers m\u00eame lors de retours qualifi\u00e9s de \u00ab\u00a0volontaires\u00a0\u00bb. Elle d\u00e9montre par ailleurs que la contrainte physique appara\u00eet comme l\u2019outil indispensable sur lequel repose l\u2019ensemble du dispositif d\u2019\u00e9loignement des \u00e9trangers ind\u00e9sirables, et cela m\u00eame lorsqu\u2019un recours effectif n\u2019est pas fait. Sur la base de cette analyse, l\u2019article vise \u00e0 mettre en lumi\u00e8re l\u2019existence d\u2019une forme de gouvernement des \u00e9trangers ind\u00e9sirables, articulant diff\u00e9rentes formes de contraintes et d\u2019incitations en vue d\u2019amener les individus \u00e0 se soumettre \u00e0 la d\u00e9cision de renvoi sans que les autorit\u00e9s n\u2019aient \u00e0 faire un recours effectif \u00e0 la contrainte physique. Nous d\u00e9signerons cette gouvernementalit\u00e9 des \u00ab\u00a0\u00e9trangers ind\u00e9sirables\u00a0\u00bb par le terme d\u2019\u00ab\u00a0expulsions volontaires\u00a0\u00bb.<\/p>\n<\/div>\n

This article analyses the deportation apparatus of unwanted migrants via the case of rejected asylum seekers in Switzerland. It questions the current political speeches according to which \u201creturn policies\u201d are first based on return incentives and would rely on coercition only as a last resort. Indeed, the analysis highlights the importance of the different forms of legal, material and psychological constraints appearing as direct consequences of a deportation order. The crucial role of these constaints should therefore also be recognized when the enforcement of the deportation order occurs in conjunction with the incentive offered within the framework of assisted voluntary return programmes. Indeed, the results of this analysis show that the potential use of physical coercition represents the cornerstone on which all the deportation apparatus is based, even in the case where this most extreme form of constraint does not have to be effectively used. On the basis of these results, the article draw attention to a form of government of unwanted foreigners that aims to submit migrants to deportation orders while at the same time restraining the costly and controversial forms of physical coercition that occurs during the deportation process. This article aims to illustrate this form of government through the notion of \u201cvoluntary deportation\u201d.<\/span><\/p>\n<\/div>\n
