Parmi quatre propositions modifiant la loi sur l\u2019asile (LAsi), l\u2019une d\u2019elles pr\u00e9sentait la possibilit\u00e9 d\u2019interdire le d\u00e9p\u00f4t des demandes d\u2019asile dans les ambassades suisses. Cette votation repr\u00e9sentait l\u2019ultime \u00e9tape d\u2019un processus de r\u00e9flexion entam\u00e9 au Parlement F\u00e9d\u00e9ral depuis plus de trois ans. En effet, si le peuple suisse a pu sanctionner positivement cette loi en juin 2013, l\u2019essentiel de son contenu f\u00fbt adopt\u00e9 et appliqu\u00e9 en amont de la votation populaire. Le d\u00e9p\u00f4t des demandes d\u2019asile en ambassade permettait aux personnes cherchant une protection de pouvoir s\u2019adresser \u00e0 une repr\u00e9sentation consulaire suisse \u00e0 proximit\u00e9 de la zone g\u00e9ographique fuie. Or, cette disposition adopt\u00e9e, les demandeurs d\u2019asile souhaitant trouver refuge en Suisse, doivent d\u00e8s lors se rendre physiquement sur le territoire suisse pour y d\u00e9poser leur demande. Parall\u00e8lement, la tendance des politiques europ\u00e9ennes en mati\u00e8re d\u2019asile et d\u2019immigration refl\u00e8tent depuis une vingtaine d\u2019ann\u00e9es une volont\u00e9 de la part des gouvernements de l\u2019Union Europ\u00e9enne et Etats associ\u00e9s comme la Suisse, la Norv\u00e8ge et l&#8217;Islande, d\u2019\u00e9tablir un contr\u00f4le dans l\u2019arriv\u00e9e des demandeurs d\u2019asile, et ce, de plus en plus en amont du territoire europ\u00e9en. Dans ce contexte, la suppression des demandes d\u2019asile en ambassade apparait paradoxale. En effet, cette mesure permettait effectivement de mettre en place un tri dans les demandes d\u2019asile en autorisant ainsi les personnes pr\u00e9sentant des motifs d\u2019asile recevables \u00e0 venir en Suisse. Comment comprendre la suppression des demandes d\u2019asile en ambassade suisse, alors que les efforts europ\u00e9ens, y compris en Suisse, tendent \u00e0 vouloir exercer un contr\u00f4le hors des fronti\u00e8res, avant l\u2019acc\u00e8s au territoire ?
